The School Lunch Program is administered by the Department of Public Instruction and supervised by the local school administrator. The current policy pertaining to foster children reads as follows:

 

In cases where the social service agency is legally responsible for the child and the foster home is in fact, an extension of the social service agency, the foster child is considered a one-member family.  Social Service agency payments for the care of the foster child are considered the income of that one-member family. Therefore, if the foster child's annual income is not above the income prescribed by the local school food authority for one-member family eligibility for free or reduced price meals or free milk, the foster child is entitled to the benefits.  Irregular payments cannot be made for school lunch or for milk.  

 

In cases where the social service agency has placed a child in a permanent home and/or subsidizes the child's adoption, the child is considered a member of the household in which he resides. The family size and total income of the family determine the child's eligibility for free and reduced price meals and free milk.
